When we consider that a breach of this acceptable use policy has occurred, we may take such action as we deem appropriate. Failure to comply with this acceptable use policy constitutes a material breach of the terms of use upon which you are permitted to use our site, and may result in our taking all or any of the following actions:
  • Immediate, temporary or permanent withdrawal of your right to use our site.
  • Immediate, temporary or permanent removal of any Contribution uploaded by you to our site.
  • Issue of a warning to you.
  • Legal proceedings against you for reimbursement of all costs on an indemnity basis (including, but not limited to, reasonable administrative and legal costs) resulting from the breach.
  • Further legal action against you.
  • Disclosure of such information to law enforcement authorities as we reasonably feel is necessary or as required by law.

If you are a consumer, please note that the terms of this policy, its subject matter and its formation are governed by the laws of the Island of Jersey. You and we both agree that the Royal Court of Jersey will have exclusive jurisdiction. If you are a business, the terms of this policy, its subject matter and its formation (and any non-contractual disputes or claims) are governed by the laws of the Island of Jersey. Read these campaign rules carefully. These campaign rules (“rules”) explain your rights and duties in connection with this campaign.

If you take part in this campaign or accept any voucher, these rules will apply to you and you agree that the promoter(s) can assume that you have read and have agreed to be legally bound by these campaign rules.

This campaign is run by Smart Money (RBN), registered in Jersey with its registered address at Floor 1, Liberation Station, The Esplanade, St Helier, Jersey, JE2 3AS (“Smart Money”).

 

In these rules, we refer to the above promoter(s) as “the promoter(s)”, or “us” or “we”.

 

We will refer to participants as “you” or “the customer”.

 

Campaign Period:

This campaign will commence at 00.01 on the 11th July 2020 and terminate at 23.59 11th August 2020 (“Campaign Period”).

 

The promoter(s) reserve the right to extend, suspend or terminate the campaign. Notice of this will be posted in these rules.

 

Participation and Qualifying Criteria:

To qualify for participation in this campaign you must:

 

·            Apply for a loan of £2,000 or more through Smart Money during the Campaign Period.

·            Minimum loan repayment period: 24 (twenty-four) months.

·            All qualifying customers whose loans are approved and paid out will be considered as participants in this campaign and will become eligible to receive 1 (one) voucher from one of the approved outlets, listed below.

 

General rules for Participation and Qualification.

 

·            Only the Borrower qualifies as a participant in this campaign.

·            If there are multiple borrowers or if a legal entity is the borrower, only one voucher will be awarded or made to the participating customer for whose account the loan was made.

·            If the loan is not approved and paid out for any reason, the customer will not qualify for the campaign.

·            All loan applications will be treated on an individual basis. The approval of a loan is based on our assessment of your personal financial circumstances. All loans are subject to status.

 

How this campaign works?

Should you meet the participation and qualifying criteria during the Campaign Period, you will automatically be considered as a participant in the Campaign, unless you inform us otherwise. You will also be expected to inform us of your choice of voucher, listed below.

 

Voucher:

£100 (one hundred pounds sterling) from one of the following outlets: 

·            M&S;

·            Amazon; and

·            John Lewis.

Who qualifies to take part?

Any Smart Money customer who has applied for a loan of £2,000 or more and whose loan has been approved and paid out during the Campaign Period qualifies for participation, unless they are automatically disqualified as described in these terms and conditions.

 

Who cannot take part?

The following persons may not take part in this campaign and may not receive a voucher:

 

·            Any employee of the promoter(s).

·            Any director, member, partner, agent of, or consultant of the promoter(s).

·            Any other person who directly or indirectly controls the promoter(s).

·            Any supplier of goods and services in connection with this campaign.

·            The spouse, life partner, siblings, children, or parents of any of the persons named above. 

Is there a limit on the number of times you can enter?

Customers will qualify for 1 (one) voucher only during the Campaign Period, subject to the qualifying criteria listed above.

 

How will the participants be notified?

·            Qualifying customers will be notified by a Smart Money representative by telephone of the approval, payment of their loan and qualification to receive a voucher of their choice, as listed in these rules.

·            Note: Where the Smart Money representative cannot reach you telephonically on the numbers you have provided, you will forfeit your entitlement to a voucher within 7 (seven) days calculated from the date of the approval of your loan.

·            Where customers agree to participate in publicity events related to the campaign, they will not be entitled to receive any payment for participating in any publicity events related to this campaign, or for participating in any media format or appearances associated with this campaign.

IMPORTANT:

 

  • You agree to indemnify the promoter(s) fully for any loss or damage the promoter(s) may suffer because you breached the campaign rules.
  • Under this entire clause “indemnify” means you agree to reimburse the promoter(s) for the following: any loss or damage they suffer, any expenses and costs they paid or are responsible for. Legal costs mean costs on an indemnity basis.
  • You also agree to indemnify the promoter(s) for any loss or damage you suffered because you took part in this campaign or used voucher. If you enter the campaign, use or accept the voucher, you understand that you do so of your own free will. This means that you cannot hold the promoter(s) legally responsible for any loss or damage or legal expenses you suffered because you took part in this campaign or used the voucher.
  • You furthermore agree to indemnify the promoter(s) fully for any loss, damage, claim, or injury that may occur because of the use of a voucher or your inability to use voucher for any reason. This includes, but is not limited to, injury, loss, death or financial damages caused to any person other than yourself.
  • You therefore agree that you cannot hold the promoter(s) legally responsible for any loss or damage or legal expenses or medical expenses you suffered caused because you used the voucher.
  • You will protect the promoter(s) from being held legally responsible for the loss or damage or legal expenses of another person (legal or natural) if such loss or damage or expense was incurred because:
    • you breached the campaign rules;
    • you took part in this campaign; and/or
    • you or any person used a voucher.
  • You agree that your participation in the campaign, and your acceptance and/or use of a voucher, or any aspect thereof, is at your own risk.
  • If a Smart Money representative is unable to get hold of you after making reasonable efforts to do so, you will forfeit your entitlement to a voucher.
  • If you fail to comply with any part of these rules you will be disqualified, and you will forfeit any voucher that you might be eligible to receive.
  • You are responsible for the tax (if any and if applicable) associated with using or accepting any voucher.
  • You may not attempt to do anything to change the outcome of the campaign in any way.
  • The judges’ decision is final, and no correspondence will be entered into. This means you cannot appeal any decision by the judges.
  • Smart Money will not be obliged to provide you with the details of any participant in this campaign, be it anonymized or otherwise.
  • The promoter(s) have the right to end this campaign at any time or substitute or change the outlets to which vouchers apply. If this happens you agree to waive (give up) any rights that you may have in this campaign and agree that you will have no rights (legal recourse) against the promoter(s).
  • The promoter(s) reserve the right to change the rules of the campaign. The promoter(s) can change the rules of the campaign throughout the duration of the campaign. For convenience only, the date on which these rules were last amended will be shown below the heading. It is your responsibility to check the rules for amendments.
  • The clauses in these rules are severable. This means that if any clause in these rules is found to be unlawful, it will be removed, and the remaining clauses will still apply.
  • Where any dates or times need to be calculated in terms of this agreement, Jersey time will be used.
  • While the promoter(s) may allow you extra time to comply with your obligations or decide not to exercise some or all of our rights, or waive certain requirements, the promoter(s) can still insist on the strict application of any or all of its rights at a later stage. You must not assume that this means that the rules have been changed or that it no longer applies to you.
  • Customers who participate in the campaign understand and agree that, in order to offer the campaign, we may collect and use personal information about customers. This personal information may include customers’, first name, last name, email address, mobile number and in certain instances your image. If we use your image, you shall not be entitled to remuneration. Personal data, which customers provide when they enter the campaign, may, subject to prevailing law, be used for future marketing activity of the promoter(s), unless you notify us that you wish to opt out of receiving such marketing communications. We will treat your information in total confidence and will not sell, share or rent this information to any other third parties. We may disclose information if required to do so by law or if it is required to protect our safety, rights or property, customers or the public.
  • This promotion and its rules will be governed by the law of the Island of Jersey regardless of where you live or work, or where or how you enter.
